Baba Suwe asks court to vacate NDLEA's detention order

Nollywood actor, Babatunde Omidina, a.k.a "Baba Suwe" has asked a Federal High Court, Lagos, to vacate its order empowering the National Drug Law Enforcement Agency (NDLEA) to detain him further over alleged drug trafficking charges.
Reports say Justice Okechukwu Okeke of the Federal High Court, Lagos, had on Oct. 21 granted the NDLEA the permission to detain the actor for 15 more days.
The NDLEA had on Oct. 12 arrested Omidina at the Murtala Mohammed International Airport, Ikeja, on the suspicion that he allegedly ingested substances suspected to be illicit drugs.

In the suit filed by his lawyer, Mr Bamidele Aturu on Monday, the actor asked the court to discharge its order granted to the NDLEA.
Aturu said the application was brought pursuant to Order 26, Rule 11 of the Federal High Court (Civil Procedure) Rules, 2009.
The lawyer said Omidina was challenging the order on grounds that the respondent NDLEA had concealed material facts relating to his health and the circumstances of his arrest and detention.
He further argued that the application for the order obtained by the NDLEA contained contradictory facts and was grossly irregular.
Aturu also said that the action constituted an abuse of court processes, adding that the order was contrary to public policy and constituted ``wanton violation of Omidina's fundamental rights.
The NDLEA had in the ex-parte application, supported by a 29-paragraph affidavit, prayed the court to permit it to continue to detain the actor pending the conclusion of its investigation on him.
The affidavit was deposed to by an NDLEA Intelligence Officer, Mr Femi Osifuye. The report of a scan result issued by a Consultant Radiologist with the Lagos State University Teaching Hospital, Dr Subhash Vijayvargiya, was attached to the affidavit.
Meanwhile, the actor has also filed a fundamental rights enforcement procedure suit against the NDLEA at the Ikeja High Court. The suit will be heard on Oct. 26 by Justice Yetunde Idowu.
